Welcome to RoutineIQ. These Terms of Service and Privacy Policy represent the comprehensive agreement between you and RoutineIQ regarding our athletic performance analysis platform. By accessing or using our services, you confirm that you have read, understood, and agreed to be bound by every provision detail herein.
01. TERMS OF SERVICE
1.1 ACCEPTANCE OF TERMS
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and RoutineIQ (“Company,” “we,” “us,” or “our”), concerning your access to and use of the RoutineIQ platform. You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service.
1.2 INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the Site and Services are our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws.
1.3 USER REPRESENTATIONS
By using the Site, you represent and warrant that:
(1) all registration information you submit will be true, accurate, current, and complete;
(2) you will maintain the accuracy of such information and promptly update such registration information as necessary;
(3) you have the legal capacity and you agree to comply with these Terms of Service;
(4) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use the Site.
1.4 PERFORMANCE ANALYSIS DISCLAIMER
RoutineIQ provides AI-driven athletic performance analysis and scoring estimations. These scores are generated based on mathematical modeling of official rubrics but do not constitute official athletic certification or guaranteed competition results. RoutineIQ is not liable for discrepancies between AI estimations and actual judge evaluations at live events.
1.5 USER GENERATED CONTRIBUTIONS
The Site may invite you to upload video content. You retain ownership of your content. However, by uploading videos, you grant us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions for the purpose of providing scores and improving our machine learning models.
1.6 PROHIBITED ACTIVITIES
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. Specifically, reverse-engineering our AI models or attempting to bypass our scoring security protocols is strictly forbidden.
1.7 TERM AND TERMINATION
These Terms of Service shall remain in full force and effect while you use the Site. WITHOUT LIMITING ANY OTHER PROVISION OF THESE TERMS OF SERVICE, WE RESERVE THE RIGHT TO, IN OUR SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE SITE TO ANY PERSON FOR ANY REASON.
1.8 LIMITATION OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
02. PRIVACY POLICY
2.1 WHAT INFORMATION DO WE COLLECT?
We collect personal information that you voluntarily provide to us when you register on the Site, express an interest in obtaining information about us or our products and Services, when you participate in activities on the Site, or otherwise when you contact us. This includes names, email addresses, usernames, and passwords. Crucially, we collect performance media (videos) uploaded for analysis.
2.2 HOW DO WE PROCESS YOUR INFORMATION?
We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with law. Specifically, performance videos are processed by our proprietary AI engine to extract kinematic data and generate technical scores.
2.3 BIOMETRIC DATA AND MEDIA USE
While our AI analyzes movement patterns, we do not store facial recognition profiles or permanent biometric identifiers beyond what is necessary to differentiate athletes within a single uploaded routine. Performance data is anonymized when used for global model training and optimization.
2.4 WHEN AND WITH WHOM DO WE SHARE YOUR INFO?
We may share information in specific situations described in this section and/or with the following categories of third parties: Cloud Computing Services (AWS/Google Cloud) and Data Analytics Services. We do not sell your personal data or uploaded media to third-party advertisers.
2.5 DATA SECURITY AND RETENTION
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure. We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy notice.
